Chapter I: General Provisions

Article 1 (Purpose)
The purpose of the General Terms and Conditions is to regulate matters relating to the management of domain names in accordance with Article 13 of the "Act on Internet Address Resources“ (hereinafter referred to as the "Act").
Article 2 (Definition)

The definitions of terms used in these General Terms and Conditions are as follows:

  • 1. Authorized Agency shall refer to an internet address registration agency accredited by the Korea Internet & Security Agency (hereinafter referred to as "KISA") for the purpose of participating in the administration of internet address registration on behalf of KISA in accordance with Article 2.6 of the Act.
  • 2. “Registrant" shall refer to the holder of a registered domain name and who uses the internet address in accordance with Article 2.4 of the Act.
  • 3. "Applicant" shall refer to an individual or a legal entity applying for the registration of a domain name
  • 4. "Admin Contact" shall refer to an individual or a legal entity delegated, by the registrant, the authority to administer the domain name.
Article 3 (Scope of the General Terms and Conditions)
These General Terms and Conditions shall apply to all services related to the administration of .kr/.hankuk domain names.

Chapter 2 : Registration and Administration of Domain Names

Article 4 (Registrant Qualifications)
  • ① Registrants must have a postal address of their place of residence in Korea.
  • ② Domain names below the specific third level domains are registered according to their respective purposes provided in Appendix 1.
Article 5 (Registration Requirements)
  • ① Registrants must have a postal address of their place of residence in Korea.
  • ② Domain names below the specific third level domains are registered according to their respective purposes provided in Appendix 1.
Article 5 (Registration Requirements)
  • ① The requirements for third level domains are as follows:
    • 1. Letters of the alphabet [A to Z] or [a to z], numbers [0 to 9], and hyphens are available for use for domain names.
    • 2. A domain name shall contain a minimum of 2 characters and a maximum of 63 characters.
    • 3. A domain name shall not begin or end with a hyphen. Consecutive hyphens are not allowed between the third and the fourth characters
  • ② Requirements for second level domains are as follows:
    • 1. A second level domain name must contain Hangeul characters (2,350 characters). Letters of the alphabet [A to Z] or [a to z], numbers [0 to 9], and hyphens are also available for second level domain name use with the exception of a combination of numbers and hyphens only.
    • 2. A domain name shall contain a minimum of 3 characters and a maximum of 63 characters, unless it contains Hangeul, in which case it shall contain a minimum of 2 characters and a maximum of 17 characters.
    • 3. A domain name shall not begin or end with a hyphen. Consecutive hyphens are not allowed between the third and the fourth characters
  • ③ The requirements for hankuk domains are as follows:
    • 1. Letters of the Hanguel(Korean character ,11,172), alphabet [A to Z] or [a to z], numbers [0 to 9], and hyphens are available for use for domain names. More than 1 hanguel must be included in.
    • 2. A domain name shall contain a minimum of 1 characters and a maximum of 17 characters.
    • 3. A domain name shall not begin or end with a hyphen., Consecutive hyphens are not allowed between the third and the fourth characters
Article 6 (Responsibility of the Registrant)
  • ① Requirements for third level domains are as follows:
    • 1. Registrants shall ensure that all information in the registration records of a domain name is up-to-date, complete and accurate.
    • 2. Upon registration of a domain name, it is the registrant's responsibility to take any necessary steps to avoid infringing on the rights of others, in violation of the law.
Article 7 (Authorized Agencies for Domain Name Registration)
KISA shall accredit authorized Agencies to provide registration services on behalf of KISA in accordance with Article 14.1 of the Act.
Article 8 (Application)

The applicant shall submit an application as provided in Appendix 2 to KISA via an Authorized Agency and provide the following information on the application :

  • 1. the domain name applied for;
  • 2. the name and address of the applicant, a copy of the certificate, and the certificate number;
  • 3. the name, address and email address of the administrator;
  • 4. name server information;
  • 5. other information required by KISA or Authorized Agency
Article 9 (Registration)
  • ① The applications are registered in the KISA database on a first-come, first-served basis. If bulk applications are anticipated to be submitted simultaneously, KISA may register the application by means such as drawing upon prior notification.
  • ② KISA reserves the right to restrict the registration of certain domain names in the public interest and in the interest of stable management of the domain name system.
Article 10 (Modification of Registration Record)
  • ① Registrants may modify the registration record of their domain names through the Authorized Agency.
  • ② Upon receiving a registrant's request to modify the registration record, KISA shall update the registrant's information in its database.
Article 11 (Termination of Registration/Deletion of Domain Names)
  • ① KISA is entitled to terminate the registration of a domain name in the following circumstances:
    • 1. when a month has passed from the date that the registration record has been confirmed as being incomplete and incorrect;
    • 2. when a month has passed from the date that the registrant has requested the deletion of the domain name;
    • 3. when the fees have not been paid for up to one (1) month after the expiration date;
    • 4. when a month has passed from the date that the registrant was confirmed as having failed to meet the requirements as described in Article 4 or 5.
  • ② As provided in the foregoing Paragraphs 1 and 2 hereof, domain names are placed on an 'on-hold' status for a period of one (1) month before deletion.
  • ③ Domain names that are placed on an 'on-hold' status shall be restored only when appropriate actions are taken by the registrant to resolve the cause of the suspension of the domain name.
  • ④ When deleting a domain name in accordance with Article 1, KISA or the Authorized Agency shall notify the registrant of the grounds for said deletion by email or other wise in writing.
Article 12 (Domain Name Dispute Resolution)
  • ① The Internet Address Dispute Resolution Committee (hereinafter referred to as the "Committee") shall receive applications for domain name dispute resolution in accordance with the Internet Address Dispute Resolution Policy (hereinafter referred to as the "IDRP").
  • ② Upon the committee's request to lock the registration record of a domain name, KISA or the Authorized Agency shall lock the registration record of the domain name.
  • ③ KISA or the Authorized Agency shall take appropriate actions in the following circumstances:
    • 1. Where a finding has been made by the committee in accordance with Article 20.4 of the Act;
    • 2. Where a determination under the IDRP has been finalized;
    • 3. Where a court order has entered into effect.

Chapter 3 : Domain Names Fees

Article 13 (Fees)
  • ① The applicant or the registrant of a domain name shall pay domain name registration fees determined by each Authorized Agency to the Authorized Agency.
  • ② The Authorized Agency shall pay the maintenance fee for the registration or renewal of domain names to KISA, pursuant to Appendix 2 of the General Terms and Conditions.
Article 14 (Fee Reduction)
KISA may reduce any part or the whole of the domain name maintenance fee provided that such a reduction is deemed necessary for the promotion of .kr /.hankuk domain names and internet utilization.

Chapter 4 : Accreditation, Management and Supervision of Authorized Agencies

Article 15 (Accreditation of Authorized Agencies, etc)
  • ① KISA may accredit Authorized Agencies to delegate the responsibilities associated with domain name registration under the provision of Article 14 of the Act.
  • ② An entity may be accredited as an Authorized Agency where it meets the following requirements:
    • 1. It shall be rated at B level or above by an operator of a credit information business as defined in Article 2 of the Use And Protection Of Credit Information Act
    • 2. It shall have a network connected to the internet by means of a designated T1 level or above line and
    • 3. It shall be issued with certification of the Security Check on Information demonstrating that it has completed the performance of the protection guidelines on information and communications network and information in accordance with Article 45 (2) of the Act on the Promotion of Information and Communications Network Utilization and Information Protection, Etc.
  • ③ KISA shall give a public notification of the application period for accreditation of Authorized Agency at least once per year.
Article 15-2 (Accreditation Process, etc.)
  • ① Anyperson seeking to be an Authorized Agency shall submit to KISA the application as set forth in Exhibit 1 (Form), attaching the following documents thereto:
    • 1. Documents to prove that the applicant meets the requirements under Article 15 (2)
    • 2. Business proposal of the Domain Name Registration Service and
    • 3. Certificate of payment of application fee as set forth in Schedule 3.
  • ② KISA will accredit an applicant as an Authorized Agency if and when it believes that the application meets the requirements of accreditation.
  • ③ The person accredited as an Authorized Agency in accordance with Paragraph 2 shall enter into a registration agreement with KISA, and shall pay the performance bond for the registration agent agreement as set forth in Schedule 3 to KISA.
Article 16 (Condition for Disqualification)
An entity, whose accreditation has been cancelled in accordance with Article 23, can only be re-accredited as the Authorized Agency after 2 years have elapsed from the date of cancellation.

Article 20 (Assignment and Merger)
  • ① Any person seeking to be assigned domain name registration service authorizationshall obtain the approval of KISA.
  • ② The surviving company or a newly incorporated company as a result of a merger with an Authorized Agency, which seeks to perform domain name registration services after the merger, shall obtain the approval of KISA.
  • ③ KISA, in granting approval pursuant to the provisions of Paragraphs 1 and 2, shall examine if the assignee or the surviving company or the newly incorporated company as a result of a merger meets the requirements under Article 15 (2).

Article 22 (Discontinuance of Registration Services and Liquidation of Legal Entity)
  • ① Where an Authorized Agency seeks to discontinue providing registration services, said Authorized Agency shall inform its registrants and KISA 30 days prior to its intended date of discontinuance.
  • ② In the case of an Authorized Agency's liquidation (due to causes other than a merger), the person in charge of liquidation shall immediately inform KISA.
Article 23 (Cancellation of Accreditation and Suspension of Registration Services)
  • ① KISA may cancel the accreditation or suspend the registration services of an Authorized Agency for a period not exceeding one (1) year if such Authorized Agency:
    • 1. Has been accredited by means of deceit or any other improper means;
    • 2. Fails to commence service within three (3) months from the date on which accreditation is granted, or suspends registration services for ten (10) consecutive days or more;
    • 3. Has employees taking advantage of their position/s as an Authorized Agency to pre-occupy domain names;
    • 4. In the event the registration services, in whole or in part, are suspended for a period not less than 24 business hours, and where notice is not provided to KISA of the reason for suspension or the schedule relating to when services will resume within 48 hours of suspension;
    • 5. Endangers the domain name registration system of KISA or its operations
    • 6. Impedes the promotion and proliferation of the registration and use of domain names;
    • 7. In the event it breaches any provisions of these Rules or other matters set forth by KISA, and receives a notice of remedy from KISA, and fails to remedy the breach thereof;

    • 9. Fails to meet the requirements set forth in accordance with Article 15 (2) < Inserted by the Rules on Domain Name Registration and Management on Oct. 24, 2005 >
    • 10. Fails to maintain at least 500 .kr/hankuk domains as of Dec. 1st of each year beginning with the following year of which it was accredited as an Authorized Agency. < Inserted by the Rules on Domain Name Registration and Managementon Jul. 5, 2007 >
      • ② In the event the accreditation is cancelled in accordance with the provision of Paragraph 1, the Authorized Agency shall promptly transfer any and all information with regard to domain name registration services in its possession to KISA or a designee of KISA.
      • ③ KISA may, where necessary, compose a committee to determine whether or not to cancel the accreditation or suspend the registration services, in whole or in part, of an Authorized Agency in accordance with the provision of Paragraph 1.
      • ④ KISA may allow the said Authorized Agency to submit a comment before it cancels the accreditation or suspends the registration services, in whole or in part, of the Authorized Agency in accordance with the provision of Paragraph 1.

Chapter 5 : Protection of Registration Records and Facilities

Article 24 (Collection of Registration Records)
  • ① The Authorized Agencies shall collect registration records described in Article 8.1 through 8.5, under the consent of the registrant.
  • ② The Authorized Agencies shall provide the information collected in accordance with the previous paragraph to KISA, and state the need to do so in its registration policy.
Article 25 (Protection of Registration Records)
  • ① KISA and the Authorized Agency shall refrain from providing any information collected in accordance with Article 24 to any third party, or use the information beyond the scope stated in the registration policy, except in the following cases:
    • 1. Domain name directory services provided by KISA (WHOIS service)
    • 2. Where otherwise prescribed by any relevant act
    • 3. In the event any government or its department or agent requests such information as mentioned in Subparagraphs 1 or 4 of Paragraph 2 in order to perform its responsibilities as prescribed by any applicable act.
  • ② The scope of information provided in WHOIS is as follows:
    • 1. domain name
    • 2. name and address of the registrant
    • 3. name, telephone number, and email address of the administrator
    • 4. name server information
    • 5. name of the Authorized Agency
    • 6. registration date, latest date of modification, expiration date
Article 26 (Protection of Facilities)

KISA will take the following measures to ensure the protection of its facilities:

  • 1. protective measures against electronic infringement
  • 2. protective measures against physical infringement
  • 3. protective measures against possible disasters
  • 4. administrative measures for the security of facilities

CHAPTER 6 : SUPPLEMENTARY PROVISIONS

Article 27 (Miscellaneous)
For matters not specified in these General Terms and Conditions, related rules determined by the president of KISA shall apply.
ADDENDA
Article 1 (Enforcement Date)
These General Terms and Conditions shall enter into effect on the date authorized by the Minister of Information and Communication.
Article 2 (Transitional Matters Concerning Authorized Agencies)
Authorized Agencies accredited by NIDA at the time of entry into the effect of these General Terms and Conditions shall be respectively deemed to be authorized Agencies accredited by NIDA as provided for hereunder.

Article 1 (Enforcement Date)
These Rules on Domain Name Registration and Management shall enter into effect on the date authorized by the Minister of Information and Communication.
Article 2 (Transitional Provision Concerning Authorized Agencies)
  • ① Notwithstanding the amendment of Article 15 (2), the previous provisions shall apply to the Authorized Agencies accredited by NIDA at the time of entry into effect of these Rules on Domain Name Registration and Management for one (1) year from the enforcement date hereof.
  • ② For Authorized Agencies accredited by NIDA at the time of entry into effect of these Rules on Domain Name Registration and Management, the following year under Subparagraph 10 of Article 23 (1) shall be 2008.
